BOWLING GREEN A Bradner, Ohio, man involved in a fatal crash last month that occurred in heavy fog on State Rt. 25 has been cited for failure to yield, authorities said.

Kent L. Tody, 24, was westbound on Sugar Ridge Road about 6:30 a.m. June 10 when he failed to yield at a stop sign at Route 25 and pulled into the path of a southbound sport utility vehicle that was being driven by James A. Fitzpatrick, 45, of Toledo, authorities said.

Mr. Fitzpatrick was pronounced dead at the scene.

Gwen Howe-Gebers, a Wood County assistant prosecutor, said possible charges of vehicular homicide and aggravated vehicular homicide were presented to a Wood County grand jury earlier this month, but the grand jury chose not to return an indictment.

The Ohio Highway Patrol then filed the minor misdemeanor charge in Bowling Green Municipal Court.
