Trial delay for ex-officer accused of sexual battery

2/15/2008

The trial date for a former Toledo Public Schools campus protection officer charged with sexually assaulting a teenage student was pushed back a month to give his attorney time to prepare his case.

Harry Weatherholt, 51, of 1010 Bowlus Ave., Lot 15, is charged with four counts of sexual battery. Yesterday, Lucas County Common Pleas Court Judge Ruth Ann Franks set a March 24 trial date on the request of attorney Sam Kaplan to give him time to review the evidence.

Mr. Weatherholt, who was arrested in November, is accused of taking a 14-year-old female student into a secluded room he used as his office at Leverette Junior High School and assaulting her.

Two of the charges stem from an incident that occurred sometime between Sept. 1 and Nov. 7. The remaining two charges stem from an incident Nov. 8, according to the indictment.

Mr. Weatherholt remains free on a $30,000 bond. He faces up to 20 years in prison if convicted on all counts.

The school district fired Mr. Weatherholt.
