Mayor pledges to move bill on carryouts

Mayor Carty Finkbeiner told Toledo City Council Wednesday that he would cast a tie-breaking vote next week to move legislation on convenience-store spacing out of committee.

He said he would do so if the ordinance proposed by Council President Joe McNamara is amended to delete an exemption for stores that do not sell tobacco products.

Council voted 6-6 last week on an effort to move the legislation out of committee. The mayor is empowered to break 6-6 votes.

The ordinance would reinstitute a pre-2004 requirement in the city's zoning code that convenience stores be 2,000 apart from each other and add a requirement that they be 1,000 feet from schools, parks, libraries, and day care centers.

The ordinance includes an exemption for stores within a community entertainment district.
