Toledoan to stay in jail until high-court review

8/26/2010

A Toledo man whose sexual-assault conviction in Lucas County Common Pleas Court was overturned last month will stay in prison until the Ohio Supreme Court acts on the prosecutor's appeal.

Justices Wednesday put on hold last month's Ohio 6th District Court of Appeals ruling that reversed the September, 2008, jury verdict in the trial of Dennis Gould.

An appellate panel ruled that police conducted an unlawful search, and Judge Charles Doneghy should not have allowed images found on Gould's computer to be used duringhis trial for raping a 7-year-old girl.

Gould, 46, who is in the Lebanon Correctional Institution in southeastern Ohio, received two life sentences for rape and an additional 13 years for child pornography.
