Ohio top court to hear Toledo child-rape case

An appeal in the case of a Toledo man whose sexual-assault conviction in Lucas County Common Pleas Court was overturned in July will be heard by the Ohio Supreme Court.

Justices said Wednesday they would consider one portion of the appeal filed by the prosecutor's office regarding an appellate court ruling that reversed the September, 2008, jury verdict in the trial of Dennis Gould.

The Ohio 6th District Court of Appeals ruled that police conducted an unlawful search, and the trial judge should not have allowed images found on Gould's computer to be used during his trial for raping a 7-year-old girl.

Gould, who is in the Lebanon Correctional Institution in southeastern Ohio, received two life sentences for rape and 13 1/4 years more for child pornography.
