BOWLING GREEN — Eight months after a Rutland, Ohio man was shot in the back outside a home in Custar, Ohio, the man charged with firing the shotgun remains incompetent to stand trial.

Thomas Boyer, 53, of Custar was before Wood County Common Pleas Judge Reeve Kelsey Monday. A competency report prepared by the Northwest Ohio Psychiatric Hospital in Toledo where Mr. Boyer is now a patient concluded that he was not able to assist with his defense but that he likely could be restored to competency.

A prior evaluation by the Court Diagnostic and Treatment Center in Toledo also found Mr. Boyer incompetent to stand trial on charges of attempted murder and felonious assault for the Nov. 20 shooting of William Morris III, 42. Mr. Boyer has pleaded not guilty by reason of insanity.

Judge Kelsey scheduled another hearing in the case for Jan. 12.
