Toledo police chief launches investigation into off-duty police firing gun

2 officers have resigned; third is under investigation

Two Toledo police officers have resigned amid an investigation into their involvement in a dispute at a downtown apartment complex while they were off duty, a third officer is under investigation, and Police Chief Derrick Diggs has launched a criminal investigation.

Toledo Lt. Mark King confirmed that officer Jada Smith resigned Wednesday and that officer Scott Macinnis resigned today. A third officer, Carlyle Gafeney, has been relieved of duty pending an Internal Affairs investigation.

According to authorities, there were reports of a woman firing a gun and trying to harm herself at about 1:30 a.m. Saturday at the Standart Lofts, 34 S Erie St. Ms. Smith and Mr. Macinnis, who were reportedly involved in the dispute, were off duty at the time.

An incident report released today said that Ms. Smith and Mr. Macinnis had a disagreement that caused Ms. Smith to become distraught. The report says that Ms. Smith then fired a gun into the floor. Officers recovered a .40 caliber handgun from the apartment and ammunition, and found a single shell casing.

Lieutenant King said today that Chief Diggs has launched a criminal investigation into the discharge of a firearm.

Officer Gafeney was not in the apartment at the time of the incident, Lieutenant King said. It was not immediately clear what connection that officer potentially has to the incident.

Toledo police had confirmed that the officers were under investigation, but have not released details on the incident.
