Douglas Prade could head back to prison after being exonerated in his ex-wife's killing, he served 15 years.

COLUMBUS — A former police captain released after nearly 15 years in prison for his ex-wife’s slaying is seeking to stay free during an appeal.

A court ruled earlier this week that ex-Akron officer Douglas Prade was wrongly released based on bite-mark DNA testing.

Attorneys for Prade asked the Ohio Supreme Court Friday to allow him to stay free while the court weighs his appeal of the 9th Ohio District Court of Appeals’ ruling.

The attorneys say Prade is living quietly in Akron, getting reacquainted with family and is not a flight risk.

Prade was freed from prison in January 2013 when now-retired Judge Judy Hunter decided there was convincing evidence of his innocence based on DNA tests.

Prade was convicted in 1998 of shooting his ex-wife, Dr. Margo Prade.
