The Ohio Attorney General's Office filed a request for more time to respond to the petition for writ of habeas corpus filed by convicted rare-coin dealer Tom Noe.
The motion was filed Wednesday in U.S. District Court. The motion requests an additional 31 days past the Aug. 19 deadline to review the "numerous state court documents." If granted, the state response would be due Sept. 19.
Noe is serving an 18-year sentence in state prison for stealing from a pair of $25 million funds he controlled for the Ohio government. A jury found him guilty in 2006 of 29 charges of corruption, theft, money laundering, and of tampering with records for the theft of millions of dollars.
In the petition filed in June, Noe's attorneys raise three claims for relief, including allegations against the trial court of improper denial of the motion to change venue, improper allowance of the state's experts, and improper denial of the defendant's experts.
The case was assigned to Judge John Adams in Akron.
