Judge sets summation deadlines for multi-use path trial

Summation briefs are due Oct. 13, and responses Oct. 27, following the conclusion of testimony Thursday in the civil trial of dueling lawsuits between the city of Toledo and Toledo Country Club over a proposed multiuse path along the Anthony Wayne Trail.

The city, which is seeking to obtain by eminent domain a sliver of country club property to connect the roadside path with a rail trail south of the golf course, rested its case Thursday afternoon.

The country club, which objects to the path on the grounds that pedestrians and cyclists could be injured either by golf balls or high-speed vehicles leaving the roadway and contends it is not allowed by the legislation under which the city built the Trail, presented its case to Gary Cook, a Lucas County Common Pleas judge trying the case from the bench, first.
