Prosecutors on Friday withdrew their plans to use an AT&T report that identified the location of cell phones belonging to a former Toledo police lieutenant and an East Toledo couple on the night they allegedly conspired to shoot a Toledo woman.
Defense attorneys for Frank Ramirez, 59, of the 5900 block of Tetherwood Drive, and John Clarke, 46, and Maytee Vazquez-Clarke, 45, both of the 400 block of Danberry Street, had asked Lucas County Common Pleas Judge Gene Zmuda to prevent the state from using the report because they claimed it was “untrustworthy on its face.”
A disclaimer on the report specifically said results were AT&T’s “best estimate of the location of the target number” and that one should “exercise caution in using these records for investigative purposes.”
The three were charged with conspiracy, felonious assault, and attempted murder for a Dec. 26, 2014, attempt to shoot Tiffany Williams in the 1300 block of Colburn Avenue.
Judge Zmuda scheduled a hearing in the case for Feb. 26, saying he would like to set trial dates at that time.
