An appeal has been filed in an arbitrator s decision to reinstate a Toledo firefighter who was dismissed in 2004 after he was accused of demanding a discount on food for himself and a friend at an ice cream stand.
The firefighter, Timothy Ciboro, filed the appeal on Friday in Lucas County Common Pleas Court to modify the award he received in the decision of Alan Miles Ruben. The case was assigned to Judge James Jensen.
Mr. Ruben ruled last month that Mr. Ciboro could return to his job if he completes an anger management program and refrains from getting into trouble with the department. Mr. Ciboro was fired in September, 2004, after an incident a few months earlier at Lickity Split on Glendale Avenue. He filed a grievance and a hearing was held in January, 2006.
